If there is any part of the Terms and Conditions that you do not understand, we recommend that you contact customer service before conducting a purchase on the website.

 

2. IMPORTANT NOTICE

READ THE TERMS AND CONDITIONS THOROUGHLY BEFORE ORDERING ITEMS FROM https://www.FREEQUENT.se/

These terms and conditions of trade (the “Terms and Conditions”) apply when you order or purchase items via the website. These terms and conditions may be updated from time to time (for example, to reflect changes in technology, our business model, our system capacity or relevant laws and regulations) and we therefore ask that you approve the Terms and Conditions each time you shop with us. Every reference to “you” or “your” means you the user of the website, while every reference to “we, “us” or “our” means Brands of Scandinavia A/S.  

If you do not accept the Terms and Conditions you will be unable to order or purchase items on the website.

You have the right to withdraw from this agreement without justification within 14 days from the day you or a third party nominated by you, though not the carrier, receives the items in their physical possession. You can read more under “Right of cancellation”.

The rules governing defects in the Danish Sale of Goods Act shall apply to your purchase which means that you have certain statutory guarantees for the items’ contractual legitimacy. You can read more under “Defective and missing items”.

Orders
Our online store is open 24 hours a day, but may sometimes be closed for maintenance. As far as possible, we try to conduct such maintenance during the night.

You must be at least 18 years of age to purchase items on the website and also hold a valid payment card that is accepted by us. If you are under 18 years of age, you must have a legal basis to enter into an agreement with us.

We can only complete your order if the delivery address is a private address or business address in Sweden.  We do not deliver to post boxes.

We retain the right to annul the purchase agreement in the following situations, without being liable for compensation or other costs:

  • Your payment details are incorrect or cannot be verified.
  • Your order was submitted with the aim of committing fraud etc. or was submitted in the context of a prosecutable action or other unlawful activity.
  • An unintended failure occurs on the website, e.g a payment error or comparable.
  • We have reason to believe you are under 18 years of age

Agreements may only be entered into via the website or via telephone to our Customer service. We do not process orders submitted via email, letter or fax.

At which point in the ordering process does the order become binding?
Before submitting your order, you have the option to change the details you have entered, including delivery, invoicing and payment information. You also have the option to change the items or to remove items from your basket.

When you click on “Buy and pay”, a receipt will be shown on your screen. The purchase agreement is binding from this point. Please read more under “Right of cancellation”.

Please contact our customer service if you made a mistake when ordering, they are ready to help.

You will receive an order confirmation via email.

After entering the purchase agreement, the rules on right of cancellation shall apply, see below.

Agreements can only be entered into in Danish.

Access to the agreement
You will receive email confirmation of the contents of the agreement as well as a copy of these terms and conditions. We store agreements we have concluded, including order confirmations, for a certain amount of time and we recommend that you likewise store these documents as they may not necessarily be subsequently accessible via the website. Please read more under, “Track your order and view purchase history”.

Measures against fraud
To protect you and our other customers against fraud and uphold a high level of security for online purchases, we may perform verification checks. The verification check can include data you send when you order via the website, including address and payment information.

 

3. PAYMENT METHODS

We accept the following payment methods:

Card Verification Value (CVV)
If you pay with a payment card, you will be asked to enter the card’s verification number (value). You will find the three-digit number on the back of your payment card, often on the right side. The verification number is necessary to complete the payment and maintain a high level of security. There may also be other equivalent security measures.

Payment procedure
When your item leaves our warehouse to be delivered to you, your payment will be withdrawn from the chosen payment service.

 

4. PRICES AND DELIVERY

All the prices indicated for items, delivery costs and other costs are inclusive of taxes, VAT and tariffs.

Costs for delivery, shipping or postage may vary and are added to each order.

You can pay using the following currencies:

We ship to:

Delivery terms and conditions
If the items are in stock, we aim for 2-4 days delivery on weekdays. We retain the right, however, to deliver within 3 working days of your purchase. Purchases made over the weekend or on a public holiday will be shipped the first following working day, if the item is in stock. Delivery will be done via GLS and SCHENKER.

Delivery costs
Purchases totalling over SEK 499 are delivered free.

The items will be delivered to the delivery address you provide when ordering. We only deliver to private and business addresses not to post boxes.

Your item will be delivered on a weekday, Monday to Friday. Delivery times will depend on the carrier that is used.

Items must be signed for on receipt. It is not a requirement that you sign personally. Persons at the delivery address (e.g. family member, friend, receptionist etc.) may sign on receipt of the items and any such signature shall be binding.

Please note that you bear the risk for the item after delivery. If the packaging looks damaged, you should refuse to accept the item. If you wish to make a complaint about any defects or deficiencies you must inform us of this, see under “Defective and missing items”.

Separate delivery consignments
If your order consists of multiple items, we reserve the right to deliver these separately. Separate delivery consignments may be necessary if some items are delayed or are not in stock at the time of ordering. You will be informed if your order is subject to separate delivery consignments. You will not be charged extra delivery costs for separate deliveries.

 

5. WARRANTY PERIOD

In accordance with the Danish Sale of Goods Act, there is a 2-year warranty period in which claims may be made. Our warranty covers defects in the materials and/or fabrication. You can have the item repaired, exchanged, money returned or a reduction in price, depending on the specific situation. The warranty does not cover defects or damages caused by improper handling of the product/service. You must claim within a “reasonable time” after discovering the deficiency/defect. Freequent.se v/ Brands of Scandinavia will cover the costs of returns if you use the returns label that is enclosed in the package.

In the event of returns, claims and exercise of the right of cancellation, the item should be returned to:

The address is already printed on the returns label that accompanies the delivery package. Simply attach the returns label and drop off at the nearest GLS package shop.

We do not accept consignments sent COD.

 

6. REFUNDS

In refund cases, the amount will be repaid to the same payment means you used in the original transaction.

 

7. RIGHT OF CANCELLATION

There is a 100-day full right of cancellation on all items purchased in our online store. This period is calculated from the day you receive your items.

We pay return costs ONLY if you use the returns label that is enclosed in the delivery package. We ask that you follow our returns guidelines, which you can read here

Under all circumstances you will not be charged a fee as a result of repayments.

We may withhold repayment until we have received the returned items or you have presented documentation of having returned the items, depending on which is earliest.

We recommend that you save postal receipts as proof that you have submitted the package to the postal service/carrier.

 

8. RETURNS

You must return your order to us without undue delay and no later than 100 days after you have exercised your right of cancellation. When returning an item you are responsible for ensuring it is correctly packed.

  • You must fill out the enclosed returns form and send it with the item.
  • You bear the risk from the time of the item’s delivery until we have received the returned item.
  • We do not accept packages sent COD.

Condition of returned item(s)
You are only liable for any depreciation of the item’s value that is due to handling other than that which is necessary to determine the item’s type, properties and the manner in which it functions. in other words you may try the item as you would in a physical store.

If the item has been tested beyond the usage described above, it will be considered used. This means that in cancelling the purchase you will only receive part or none of the purchase amount in return, depending on the item’s trade value at the time of receipt of the returned item. In order to have the full purchase amount returned, therefore, you may only try the item without actually using it.

Repayments
If you cancel your purchase, you will of course have the money you paid to us returned.

In the event of value depreciation, which you are liable for, this will be deducted from the purchase amount.

When you exercise your right of cancellation, all payments received from you will be returned, including delivery costs (excepting extra costs as a consequence of you choosing another delivery form than the cheapest form of standard delivery we offer) without undue delay and no later than 14 days from the date we received your return delivery. Repayments are carried out using the same payment method you used for the original transaction.


Missing or incorrect items
If you observe defects/deficiencies at the time the carrier attempts to complete delivery, you should refuse to accept the delivered item(s).

In the event of missing or incorrect items, you can choose one of the following options:

  • Return the item and have the purchase amount and all delivery costs refunded, after our customer service has processed the returned item,
  • Return the item and receive an equivalent item after our customer service has processed the returned item, conditional upon us being able to deliver an equivalent item, or
  • Retain the item and request a proportional reduction in the purchase price

When you contact customer service, please provide the order number, any item number and describe what is wrong with the item.

You are not liable for any costs associated with returning defective or incorrect items. We will of course refund the purchase price and original shipping costs when we have received the item, unless you receive a new item to replace the original.


9. OTHER CONDITIONS

Updating the website

We do our best to update our website and ensure that prices, offers, descriptions and other information about items is correct. Typos, errors in pricing, offers, descriptions and other information on items may, however, occur and sometimes we discover that the price for an item is listed incorrectly.

Force Majeure
We are not responsible for delays or failure to fulfil our obligations in accordance with the Terms and Conditions if the delay or unfulfillment are due to events beyond our reasonable control.

Completeness of the agreement
These Terms and Conditions constitute the totality of the terms for the agreement between us.

Invalidity
If one or more of the provisions in the Terms and Conditions are declared wholly or partially invalid, the other provisions remain in force.

Transfer
We are entitled to transfer our rights and obligations under the agreement entered into with you to any third party. A transfer is naturally conditional upon the standard of service you receive not being impaired. We will notify you in the event of any transfer. By accepting these terms and conditions you consent to any such future transfer. At the same time you accept that, from the time we notify you of the transfer, your contractual rights may only be enforced upon the third party in question.

Personal data
We process your personal data with full confidentiality. Please read our personal data policy here, which states how we use the personal data you provide in connection with ordering and your other usage of the website.

Complaints
You are of course always welcome to contact our customer service, if you have any complaints on an item purchased from us. Our customer service can be contacted by telephone, email or regular post. You will find contact details for our customer service under “General information” above.

You can also lodge a complaint about an item you have purchased from us to the Danish Center for Klageløsning, Nævnenes Hus, Toldboden 2, 8800 Viborg. You can complain to the Danish Center for Klageløsning via the complaints portal for Nævnenes Hus

You can also use the EU Commission’s online complaints portal to submit a complaint. This is particularly relevant if you are currently resident in another EU country. Choice of law and venue
Every agreement entered into between us under application of these Terms and Conditions is subject to Danish law. Any dispute that may arise in connection with our agreement, including the existence or validity of the agreement, shall be brought before a competent court in Denmark.
